Agreement to terms
These Terms of Service ("Terms") govern your access to and use of the website, software platforms, and hardware products provided by IDATARAYA SDN. BHD. (201801001415 / 1263428-K) ("idataraya", "we", "us", "our"). By accessing or using our services, you agree to be bound by these Terms.
If you are using our services on behalf of a business, you represent that you have authority to bind that business to these Terms.
Services
idataraya provides the following:
- Software platforms — asasii POS, asasii BSC, and related products accessed through web, desktop, or embedded interfaces
- Hardware — point-of-sale terminals, peripherals, and accessories sold or leased under the asasii brand
- Professional services — custom software development, data engineering, analytics, and integration work delivered under separate agreements
Specific features, pricing, and service levels are described in the applicable product documentation or your subscription agreement.
Accounts
To use certain services, you must create an account. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account.
- Provide accurate and complete registration information
- Notify us immediately if you suspect unauthorised access
- Do not share accounts or credentials across organisations
We may suspend or terminate accounts that violate these Terms or remain inactive for more than 12 consecutive months.
Acceptable use
You agree not to:
- Use the services for any unlawful purpose or in violation of Malaysian law
- Attempt to gain unauthorised access to any part of the services or related systems
- Reverse-engineer, decompile, or disassemble any software we provide
- Introduce malicious code, viruses, or other harmful material
- Use the services to store or transmit data that infringes third-party rights
- Resell, sublicense, or redistribute the services without written permission
- Interfere with or degrade service performance for other users
Intellectual property
All software, designs, trademarks, documentation, and content provided through our services remain the exclusive property of IDATARAYA SDN. BHD. or our licensors and are protected by Malaysian and international intellectual property laws. These Terms do not grant you any ownership rights.
You retain ownership of any data you upload or create using our services. You grant us a limited licence to host, process, and display that data solely to operate the services on your behalf.
Your data
You own the data you store in our platforms. We treat your data as confidential and process it in accordance with our Privacy Policy.
- We do not sell your data to third parties
- We do not use your data to train machine learning models without explicit consent
- You can export your data at any time through our platform tools or by contacting support
- Upon account termination, we retain your data for 90 days before permanent deletion
Hardware terms
Hardware purchased or leased from idataraya is covered by the following:
Warranty
All asasii-branded hardware carries a 12-month warranty from the date of delivery, covering defects in materials and workmanship under normal use. The warranty does not cover damage from misuse, modification, liquid exposure, or unauthorised repair.
Returns
Hardware may be returned within 14 days of delivery if it is unused and in its original packaging. Contact support to initiate a return. Shipping costs for returns due to change of mind are borne by the buyer.
Repairs
For warranty claims, we will repair or replace the defective unit at our discretion. Out-of-warranty repairs are available at published service rates.
Payment and billing
Platform subscriptions are billed monthly or annually as specified at the time of purchase. Hardware is billed at the point of order.
- All prices are in Malaysian Ringgit (MYR) unless stated otherwise
- Payments are processed through FPX, DuitNow, or supported card networks
- Overdue invoices may incur a late payment charge of 1.5% per month
- We reserve the right to suspend access for accounts with invoices overdue by more than 30 days
Service availability
We aim to maintain high availability for all platform services but do not guarantee uninterrupted access. Planned maintenance is communicated in advance. We are not liable for downtime caused by factors outside our reasonable control, including internet outages, natural disasters, or third-party service failures.
Limitation of liability
To the maximum extent permitted by Malaysian law:
- Our total liability for any claim arising from these Terms or the services shall not exceed the amount you paid us in the 12 months preceding the claim
- We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profit, data, or business opportunity
- We are not liable for losses caused by your failure to maintain adequate data backups
Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under Malaysian law.
Indemnification
You agree to indemnify, defend, and hold harmless IDATARAYA SDN. BHD., its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from your violation of these Terms, your misuse of the services, or your infringement of any third-party rights.
Termination
Either party may terminate the service relationship:
- You — by closing your account through the platform settings or by written notice
- Us— immediately if you materially breach these Terms, or with 30 days' notice for any other reason
Upon termination, your right to use the services ceases. We will make your data available for export for 90 days following termination.
Changes to these terms
We may revise these Terms from time to time. Material changes will be communicated at least 30 days in advance through our website or by email. Continued use of the services after the effective date constitutes acceptance of the revised Terms.
Governing law
These Terms are governed by the laws of Malaysia. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
